PRESS RELEASE 9/22/10

Dina Padilla Calls For Removal of Yolo County Fraud Unit Lt. Daniel Stroski
For Incompetence

9/22/2010

CA Insurance Commissioner Peace and Freedom Party candidate Dina Padilla is calling for the immediate removal of Yolo County Workers Comp Fraud Unit chief Lt. Daniel Stroski. Stroski testified at the California Department of Insurance Fraud Assessment Commission FAC meeting in Sacramento on September 8, 2010 meeting that he "did not know what employee right are". Part of Stroski's job classification is to prosecute employers and insurance companies for violation of employee rights by refusing to provide workers compensation benefits.

The testimony of Lt. Daniel Stroski is at http://www.youtube.com/watch?v=iG84H6Ic7IE

Padilla stated that "The public is ill served when it pays a Lt. in the Yolo County over $100,000 to enforce the worker compensation law and when that employee says he does not know what the law is in order to protect employee's rights."

Stroski has also refused to prosecute crooked Agraquest owner Pam Marrone and the Liberty Mutual Insurance company for workers compensation fraud against injured biotech worker David Bell and instead has targeted injured workers for alleged fraud while ignoring the insurance industry and employers.

Padilla called for Steve Poizner, Insurance Commissioner and Jerry Brown, the Attorney General "to open investigations on Stroski's statement and how this individual could have held such a law enforcement position for so many years."

Padilla also raised the issue of competence of the members of the Fraud Assessment Commission members. After Stroski made the statement that he did not know what the law is concerning employee rights, the FAC members voted unanimously to award Lt. Stroski and his department  $254,000 which was the amount that Stroski was requesting.  According to Padilla, "apparently incompetence and malfeasance is something that this Fraud Assessment Commission wants to award with more public funds. This is another indication that the Department of Insurance has a systemic problems of kowtowing to the insurance industry and employers instead of defending the public and injured workers." She is also calling the other candidates for Insurance Commissioner to join her in this call for the removal of Lt. Stroski. Padilla also continues to call for Democratic Party Insurance Department candidate Dave Jones to participate in debates with all the qualified candidates for insurance commissioner. Jones continues to duck debates and refuses to stand up for the injured workers of California who are fighting for justice and prompt treatment of their injuries.

Padilla has also demanded that the Insurance Commission begin to prosecute the insurance industry and large employers for cost shifting the cost of injured workers to State, SSD-Federal, Medicare, SSA and SSI with the Federal government.
